Tax-exempt status is generally an essential element of a nonprofit's organization and operations. Compliance with the requirements of a particular tax-exempt status (e.g., 501(c)(3)) can at times be confusing and challenging, particularly in areas where there is great disinformation. We advise nonprofits on various tax compliance matters, including with respect to charitability, private inurement and private benefit, unrelated business activities and UBIT, lobbying, and political activities. We educate nonprofits on their abilities to advocate for their missions consistent with their values and navigate through various obstacles and threats. We also draft and review agreements and policies for consistency with tax-exempt status and advise on how affiliated structures can increase flexibility in advancing an organization's mission.
